Terms and Conditions

1. Agreement

Welcome to BigTeamGolf ("App"), owned and operated by Black Dog Apps, LLC ("BDA LLC," "we," "our," or "us").

These Terms and Conditions ("Terms") govern your use of the BigTeamGolf iPhone application and the app.bigteamgolf.com application and related services.

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms.

2. Apple Acknowledgement

These Terms are concluded solely between you and BDA LLC, and not with Apple Inc.

Apple is not responsible for the BigTeamGolf App, its content, maintenance, support, or any claims relating to the App.

3. License

Subject to these Terms, BDA LLC grants you a limited, non-exclusive, non-transferable, revocable license to use BigTeamGolf on Apple-branded devices and other devices that you own or control, as permitted by Apple's Usage Rules.

You may not:

  • Copy or distribute the App.
  • Modify, reverse engineer, decompile, or disassemble the App except where permitted by law.
  • Rent, lease, sublicense, or sell the App.
  • Use the App for unlawful purposes.

All rights not expressly granted remain the property of BDA LLC.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials.

You agree to provide accurate information and promptly update it if it changes.

You are responsible for all activity occurring under your account.

5. Golf Scores and Handicap Information

BigTeamGolf allows users to organize golf events and, where authorized, submit eligible scores to the World Handicap System™.

You certify that, to the best of your knowledge, all BigTeamGolf competitions that are submitted to the World Handicap System™ were played in accordance with the Rules of Golf and the Rules of Handicapping, and the scores submitted accurately reflect each player's acceptable score for handicap purposes.

BDA LLC does not guarantee that every submitted score is eligible for handicap posting; rather, this is the responsibility of the user.

6. GHIN® Integration

If you connect your GHIN® account, you authorize BigTeamGolf to:

  • Retrieve your handicap information.
  • Verify your membership.
  • Submit eligible scores on your behalf.

Your use of GHIN® services remains subject to the applicable USGA terms and policies.

7. Acceptable Use

You agree not to:

  • Submit false or fraudulent golf scores.
  • Attempt to gain unauthorized access to the App.
  • Upload malicious software.
  • Interfere with the operation of the App.
  • Violate applicable laws or regulations.

Violation of these Terms may result in suspension or termination of your account.

8. Intellectual Property

BigTeamGolf, including its software, graphics, logos, trademarks, databases, and content, is owned by Black Dog Apps, LLC and is protected by United States and international intellectual property laws.

No ownership rights are transferred to you.

9. Third-Party Services

The App may communicate with third-party services, including the World Handicap System™ and cloud service providers.

BDA LLC is not responsible for the availability, accuracy, or policies of third-party services.

10. Privacy

Your use of BigTeamGolf is also governed by the BigTeamGolf Privacy Policy, which explains how we collect and use personal information.

11. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE."

To the fullest extent permitted by law, BDA LLC disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted or error-free operation.

12. Limitation of Liability

To the maximum extent permitted by law, BDA LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of your use of the App.

Our total liability shall not exceed the amount paid by you for the App during the twelve months preceding the claim, or US$50 if the App was provided without charge.

13. Maintenance and Support

BDA LLC is solely responsible for providing maintenance and support for the App.

Apple has no obligation to provide maintenance or support services.

14. Product Claims

BDA LLC is solely responsible for addressing claims relating to the App, including claims regarding product liability, legal compliance, or consumer protection laws.

15. Intellectual Property Claims

If a third party claims that BigTeamGolf infringes its intellectual property rights, BDA LLC—not Apple—is solely responsible for investigating, defending, settling, and resolving such claims.

16. Legal Compliance

You represent and warrant that:

  • You are not located in a country subject to a U.S. Government embargo.
  • You are not listed on any U.S. Government list of prohibited or restricted parties.

17. Termination

We may suspend or terminate your account if you violate these Terms or misuse the App.

Upon termination, your license to use the App immediately ends.

18. Changes to These Terms

We may update these Terms from time to time.

Continued use of the App after changes become effective constitutes acceptance of the revised Terms.

19. Governing Law

These Terms shall be governed by the laws of the State of Alabama, United States, without regard to conflict of law principles.

21. Apple Third-Party Beneficiary

You acknowledge and agree that Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.
